Tim is a widely experienced Barrister and Solicitor and until recently was an international arbitration partner at US law firm Dechert LLP.  He is an experienced trial litigator, and is acknowledged globally as an "outstanding advocate" with an "outstanding reputation".  Tim's client-first approach, tenacity and attention to detail set him apart as an advocate for his clients' interests.  He is admitted to practice in New Zealand and England.  

Expertise

Tim is a commercial litigator and arbitration counsel. An experienced trial lawyer, he has particular expertise in corporate/shareholder disputes, M&A and post-acquisition disputes, complex contractual disputes, banking and financial services (creditor and debtor), foreign investment law and investment arbitration, energy/resources disputes, telco/IP/technology disputes and regulatory defence.

In addition to his experience in the courts, Tim has appeared as counsel in some of the most significant international disputes in recent times before the world’s leading arbitration institutions (e.g., ICC, LCIA, ICSID and the Permanent Court of Arbitration at the Hague). For example, the ground-breaking Abyei Arbitration (border delimitation between Sudan and what is now Southern Sudan), Microsoft v Samsung (IP royalties and technology collaboration), Perenco v Ecuador and Burlington v Ecuador (multi-billion dollar claims by foreign oil companies under bilateral investment treaties), Vivendi v Deutsche Telekom (at the time the largest ICC claim ever made), and numerous significant confidential commercial arbitrations.

Tim’s clients are able to draw on his experience acting for parties from or investing in all major global economies, including the US, Europe, Russia & CIS, Eurasia, the Middle East, India, Africa, Asia, Latin America and the Asia-Pacific, across a broad range of industries.

Tim has been recognised by international directories Chambers, Legal 500, Global Arbitration Review, Who's Who Legal, Euromoney and SuperLawyers as a leading disputes lawyer. He was recently named as one of the Top 5 'Most Highly Regarded' arbitration lawyers under 45 in 'Rest of World' (outside Europe and Americas) by Who's Who and Global Arbitration Review. Leadership

Tim is a leader in the dispute resolution field internationally.

His leadership roles include appointment to:

  • the ICC Court of Arbitration (New Zealand alternate representative)
  • the ICC Commission on International Arbitration (New Zealand) alternate representative) where he has participated in the drafting of the 2012 edition of the ICC Rules and was a leader on the ICC Commission’s Task Force on Financial Institutions and Arbitration and a member of the ICC Commission’s Task Forces on Witness Evidence in Arbitration and Decisions on Costs in International Arbitration
  • the ISDA Arbitration Committee, which released its ISDA Arbitration Guide in 2013
  • the AMINZ Arbitration Rules drafting committee

Tim is regularly invited to speak at conferences internationally, and teaches international dispute resolution topics at leading law schools.

Tom is a senior member of our litigation and arbitration practice and is an experienced barrister and solicitor.  He appears in the courts at all levels, in arbitrations, and before specialist tribunals.

Expertise

Tom is an experienced commercial litigator. He graduated LLB(Hons) from the University of Auckland in 2011. Tom then joined Bell Gully and worked in the firm’s litigation department for five years on a broad range of complex and significant cases.

During his time at Bell Gully, Tom completed an LLM (Hons) at the University of Auckland under the supervision of Professor Peter Watts QC. Tom then practised as a junior barrister at Bankside Chambers. A number of Tom’s articles have been published in New Zealand legal publications and he has been a regular contributor to the Company and Securities Law Bulletin since 2011.

Tom focuses on commercial disputes and has particular expertise in complex contractual disputes, company and securities law, banking and finance disputes, competition law, regulatory investigations (such as Commerce Commission and Financial Markets Authority), professional negligence, and class actions. He is also well-versed in acting on criminal matters and complex trust, estate, and relationship property law disputes.
